Policy on Use of Campus Property


A revised Policy on Use of Campus Property will be available for public comment through March 2. The revised policy complies with a new state law that went into effect in 2018. For review, the current policy can be found at In addition to edits for clarification, substantive edits are proposed which reflects transition to the Board of Trustees, arranges the policy in the University’s new policy format, clarifies definitions and procedures for Affiliated Entities and Non-Affiliated Persons, establishes Public Speaking Areas (limited public forums), and includes procedures for Food Vendors on Campus.

Re: Section 1-C, the requirement to show identification. 

This seems vague and extralegal.  To my knowledge there is no stop and identify statute in TN, so what authority is there to arbitrarily require anyone to show ID on a public university?  Furthermore, the term "University Official" is never defined.  It is used liberally throughout the document but never defined.  As such it could be construed that any university employee or student could demand anyone else's ID at any time for any reason, and without consenting the person could be removed or subject to university and/or legal prosecution.  

This section doesn't pass the civil liberties test to me.

Doesn’t V. D directly conflict with the state policy that says Section 6.a. 11 through 14. 14 specifically says their shouldn’t be permits required that preclude spontaneous outdoor assemblies. 12 says they free speech zones shouldn’t be limited to certain areas of campus. Our policy seems to be in direct contradiction to these.
